Copyright, licensing, and intellectual property rights for all content published in JDHK

Copyright Ownership

Authors of manuscripts accepted for publication in Jurnal Dharmaputra Hukum Kesehatan (JDHK) retain full copyright of their work. JDHK does not require authors to transfer copyright to the journal or the publisher. This author-retention policy is consistent with the principles of open-access publishing and the Budapest Open Access Initiative (BOAI).

By submitting a manuscript to JDHK, authors grant the journal a non-exclusive, irrevocable, worldwide licence to publish, reproduce, distribute, and archive the article in all formats (print and digital) under the terms of the Creative Commons Attribution 4.0 International (CC BY 4.0) licence.

All articles published in JDHK are made available under the CC BY 4.0 licence. This is the most permissive Creative Commons licence, allowing maximum reuse of published content while ensuring authors receive proper attribution.

One Condition — Attribution Required

Any use of JDHK-published content must include appropriate credit to the original authors, provide a link to the CC BY 4.0 licence (creativecommons.org/licenses/by/4.0), and indicate if any changes were made. Attribution must be given in a manner that does not imply the authors endorse any particular use of the work.

Permitted Uses of Published Content

The following uses of JDHK-published articles are permitted without prior written permission from the journal, provided that proper attribution is given:

Academic citation and quotation in other scholarly works, theses, dissertations, and presentations, with full bibliographic reference.
Self-archiving by authors in personal, institutional, or subject repositories (pre-print, accepted manuscript, or published PDF), at any time with no embargo.
Translation of articles into other languages for scholarly or educational purposes, provided the original source is cited and a disclaimer is added stating it is a translation.
Reproduction in educational materials (courseware, lecture notes, textbooks) for non-commercial teaching purposes with attribution.
Sharing on social media, academic networks (ResearchGate, Academia.edu), or professional platforms with a link to the original published article.
Data mining, text mining, and computational analysis of published content for research purposes, subject to JDHK's technical terms of access.

Third-Party Content and Permissions

Authors are solely responsible for obtaining all necessary permissions for any third-party material included in their manuscripts — including figures, tables, photographs, maps, data sets, or substantial quotations — that are protected by copyright and are not covered by a permissive open licence.

Author Responsibility

Written permission from the original copyright holder must be obtained before submission and documentary evidence provided upon request. Permission must allow for unrestricted open-access reproduction under CC BY 4.0. JDHK accepts no liability for any infringement of third-party intellectual property rights.

Figures & Images

All figures and images not created by the authors must include a proper attribution line and written permission from the copyright holder.

Tables & Data

Tables or datasets reproduced or adapted from previously published works require a credit line and permission unless the source is openly licensed.

Quotations

Extended quotations beyond fair use must be cleared with the copyright holder. Brief quotations for critical commentary or analysis are generally permissible under applicable fair-dealing provisions.

Originality and Plagiarism

All manuscripts submitted to JDHK must be original works of the submitting authors. By submitting, authors warrant that the manuscript has not been published previously (except as a preprint), is not under consideration elsewhere, and does not infringe the intellectual property rights of any third party. All manuscripts are screened using Turnitin prior to peer review.

Revision Required

Author must revise and reduce similarity before proceeding.

Rejected

Manuscript is rejected outright for excessive similarity.

Moral Rights

JDHK fully respects the moral rights of authors as defined under Undang-Undang Republik Indonesia No. 28 Tahun 2014 tentang Hak Cipta and the Berne Convention for the Protection of Literary and Artistic Works. These rights are inalienable and exist independently of copyright ownership.

Right of Attribution (Hak Paternity)

Authors have the right to be identified as the creators of their work in all uses and reproductions. JDHK always publishes author names and affiliations as provided, and requires all users of the content to attribute the work correctly.

Right of Integrity (Hak Integritas)

Authors have the right to object to any modification, distortion, or mutilation of their work that would be prejudicial to their honour or reputation. JDHK does not make substantive edits to accepted manuscripts without author approval.

Retraction, Correction, and Removal

JDHK maintains the integrity of the published record in accordance with COPE Retraction Guidelines. The following actions may be taken when errors or misconduct are identified after publication:

Correction

Issued when a small portion of an otherwise reliable article is found to be misleading or contains errors. The original article remains available with the correction notice linked.

Expression of Concern

Published when there is evidence of possible research misconduct but investigation is ongoing, or when an institution has failed to investigate a credible allegation.

Retraction

Issued when major errors invalidate the findings, or when research misconduct (fabrication, falsification, plagiarism, duplicate publication) is confirmed. The article is marked as retracted but remains visible in the record with a retraction notice.

Copyright Complaints and Takedown Requests

If you believe that content published in JDHK infringes your copyright or intellectual property rights, please contact the editorial office promptly with the following information: (a) identification of the copyrighted work you claim has been infringed; (b) the URL or other specific location of the allegedly infringing content; (c) your contact information; and (d) a statement that you have a good-faith belief that the use is not authorised by the copyright owner. JDHK will investigate all claims in good faith and respond within 14 working days.
